The domain name www.aarohlaw.com (hereinafter referred to as the “Website”) is owned by and operated through its founder, Advocate Rohan Sharma having a law firm, Aaroh Law having its principal office at Ahmedabad, Gujarat, India.
ii. These Terms and Conditions (hereinafter referred to as the “Terms”) govern the use of Website and the User (hereinafter referred to as “You” or “Your”) of this Website. The Terms and Conditions governs the access to and use of the Website, including any content, functionality, services, publications, blogs, toolkits, forms, and resources offered through or on the Website. We duly comply with the Information Technology Act, 2000 (as amended by Information Technology (Amendment) Act, 2008 and the rules made thereunder, including the Information Technology (Reasonable security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011, Trade Marks Act, 1999, Copyrights Act, 1957, Indian Contracts Act, 1872 and any other applicable laws in force in India.

No Solicitation or Advertisement: Aaroh Law conducts its professional practice in strict accordance with the Bar Council of India Rules, 1975, including but not limited to Rule 36 governing the professional standards and duties of enrolled Advocates. Nothing contained on this Website shall be construed as solicitation, advertisement, personal communication, invitation or inducement of any sort whatsoever to solicit or advertise legal services or create an attorney client relationship.

13. DISPUTE RESOLUTION:
a. In the event of any dispute, controversy or claim (“Dispute”) arising out of or in connection with these Terms and Conditions, including any question regarding their existence, validity, interpretation, performance, breach or termination, the Parties shall endeavour to resolve such Dispute amicably through mutual discussions and good faith negotiations, to be concluded within thirty (30) days from the date on which either Party provides written notice to the other Party specifying the nature of the Dispute.
b. If the Parties are unable to resolve the Dispute amicably within the aforesaid period, the Dispute shall be finally settled by arbitration in accordance with the provisions of the Arbitration and Conciliation Act, 1996 (as amended from time to time). The arbitration shall be conducted by a sole arbitrator jointly appointed by both Parties. In the event that the Parties are unable to mutually agree upon the appointment of the sole arbitrator within fifteen (15) days from the conclusion of the negotiation period, the appointment shall be made in accordance with the rules of the Indian Council of Arbitration.
c. The seat and venue of arbitration shall be Ahmedabad, Gujarat, India, and the proceedings shall be conducted in the English language.
d. Notwithstanding the foregoing, either Party shall be entitled to seek interim, injunctive or equitable relief from any court of competent jurisdiction to safeguard its interests or to preserve the subject matter of the Dispute, pending the conclusion of arbitration proceedings.
e. Unless otherwise directed by the arbitral tribunal in its final award, the costs of the arbitration proceedings shall be shared equally between the Parties.
14. GOVERNING LAW & JURISDICTION:
a. Governing Law: These Terms of Use and any disputes arising out of or in connection with them or Your use of this Website, shall be governed by and construed in accordance with the laws of India, including but not limited to The Information Technology Act, 2000 (as amended), The Indian Contract Act, 1872, Copyrights Act, 1957, Trade Marks Act, 1999 and any other applicable laws and regulations.
b. Jurisdiction: Subject to any mandatory statutory provisions, You and Aaroh Law irrevocably agree that:
i. The courts at Ahmedabad, Gujarat, India shall have exclusive jurisdiction over any dispute, claim or controversy arising out of or relating to these Terms or Your use of the Website.
ii. You waive any objections to the venue of such courts on grounds of inconvenient forum or otherwise.
c. The formal legal proceedings shall be pursued in case the dispute resolution mechanism mentioned (under Clause 13) in the Terms and Conditions fails to address and resolve the dispute successfully.
15. LIMITATION OF LIABILITY:
a. Maximum Extent Permitted by Law: To the maximum extent permitted by applicable law, under no circumstances shall Aaroh Law, its partners, employees, consultants, agents or affiliates be liable for:
i. Any indirect, incidental, special, consequential, punitive, or exemplary damages, including but not limited to loss of profits, data, goodwill, or business opportunity, arising out of or related to Your use or inability to use the Website;
ii. Any damages resulting from errors, omissions, interruptions, defects, delays or failures in the Website or its content, even if Aaroh Law has been advised of the possibility of such damages.
b. Total Liability Cap: Aaroh Law’s total cumulative liability to You for any claim arising out of or relating to these Terms or Your use of the Website shall in no event exceed the amount You have paid, if any, to Aaroh Law for access to or use of the Website.
c. Exclusions: Some jurisdictions do not allow the exclusion or limitation of certain damages, accordingly, some of the above limitations may not apply to You.

e. Assignment: You shall not assign or transfer any of Your rights or obligations under these Terms without the prior written consent of Aaroh Law. Aaroh Law may assign its rights and obligations under these Terms without restriction.
f. No Partnership or Agency: Nothing in these Terms shall be construed as creating any partnership, joint venture, employment, or agency relationship between You and Aaroh Law.
